Customer Service Agreement

1. Introduction

This agreement outlines the terms and conditions for services provided by Pixel Partner Digital, hereafter referred to as “Company,” to you, the “Customer.” By signing this contract, the Customer acknowledges and agrees to the terms described for the development, management, and maintenance of a custom website.

2. Scope of Service

The Company will deliver the following:

  • A professionally designed website tailored to the Customer’s chosen template and content.

  • Ongoing support and maintenance during the active contract period.

  • Additional services per the selected package (Starter, Deluxe, or Premium).

3. Contract Term

The Customer agrees to a 24-month service contract. This contract is binding for the full duration, starting from the date the website goes live.

4. Payment Terms

  • The Customer commits to a fixed monthly payment based on their selected package:

    • Starter Plan: $195/month

    • Deluxe Plan: $295/month

    • Premium Plan: $395/month

  • After the 24-month period, the Customer’s rate will reduce to $95/month on a month-to-month basis, regardless of the package.

  • Any optional upgrades will remain an additional cost. The Customer may continue using these upgrades post-24 months on a month-to-month basis, with 30 days’ notice required for cancellation.

5. Non-Payment Policy

  • If the Customer fails to make a monthly payment, the Company reserves the right to take the website offline after 30 days of non-payment.

  • Service can be reinstated once outstanding balances are paid in full.

6. Cancellation Policy

The Customer may choose to cancel the service before the end of the 24-month term under the following conditions:

  • Cancellation with Transfer of Website: If the Customer wishes to cancel and retain the rights to the website, they must pay the remaining balance for the term in full. For example, at $195/month, if canceling after month 18, the Customer will owe $1,170.

  • Cancellation Without Transfer of Website: If the Customer cancels without taking ownership of the website, they are responsible for 50% of the remaining balance. For instance, at $195/month after month 18, the remaining cost owed would be $585.

  • In all cancellation cases, the Customer must provide 30 days’ written notice, after which billing will cease.

7. Ownership and Transfer

  • During the 24-month term, Pixel Partner Digital retains ownership of the website’s code and design. The Customer owns all original content they provided.

  • Ownership of the website’s design can be transferred upon completion of payment for the full remaining term, per Section 6.

8. Support and Maintenance

  • The Company will provide continuous support, including updates, backups, uptime monitoring, and security during the contract term.

  • Post-24 months, support continues on a month-to-month basis, as outlined in Section 4.

9. Upgrades and Additional Services

  • If the Customer has opted for additional services or upgrades, these will continue as recurring charges unless canceled with 30 days’ notice.

  • Upgrades can be maintained independently, even after canceling the core service, under month-to-month billing.

10. Termination and Notice

  • A 30-day notice is required for any cancellation or downgrade of service, both within the contract period and after transitioning to month-to-month terms.

  • Upon termination, all obligations and billing cease after the final month.

11. General Terms

This agreement, signed and executed by both parties, constitutes the entire contract between the Company and the Customer. Any amendments must be agreed upon in writing.
